Rhodri Thompson QC is a specialist in competition law and European Union law. He is also a recognised leader in public law and sports law. He received the 2008 EU/Competition law Silk of the Year Award from Chambers and Partners.

Rhodri was a founder member of Matrix and Chair of the Management Committee from 2004 to 2006. He is a qualified negotiator and mediator and became a Civil Recorder in 2010.

Competition Law

Rhodri is a leading specialist in competition law. Recent and current cases include the recent Tobacco appeals in the CAT, successful appeals against the OFT’s decision in respect of “cover pricing” in the construction sector, an ongoing Ofcom investigation of BT’s wholesale pricing, intervention on behalf of HSBC in the MasterCard appeal to the CFI and related OFT proceedings, OFT cartel investigations of the UK dairy sector and supermarkets, and appeals in respect of copper fittings and methacrylates cartel decisions of the EC Commission.

Rhodri acted for Albion Water in the CAT and Court of Appeal in its long-running appeals in respect of competition in the UK water industry. He acted for the OFT in the Genzyme and Attheraces appeals before the CAT and for the European Commission in the Pre-insulated pipes cartel appeal to the ECJ. He represented Which? in the first “follow on” consumer damages action in respect of the Replica Kit cartel.

European Union Law

Rhodri is also a leading expert in EU law. Rhodri advises and acts for a wide range of commercial and public bodies, including the Bank of England, the BBC, the ORR and the European Commission as well as for private individuals asserting their EC law rights against the UK and EU authorities. As a member of the Treasury Panel from 1997 to 2002, Rhodri represented the United Kingdom in a series of cases before the ECJ. Rhodri commenced his practice by working for two years in Brussels and is thus familiar with the different perspective and practice style of the EU institutions. He has a specific expertise in pharmaceutical regulation and sports and media law.

Rhodri recently acted in a number of major dumping actions before the CFI on behalf of Chinese and Indian importers, and for BT in an appeal to the CA and preliminary ruling concerning the provision of directory information under EU law.

Administrative Law

Developing out of his EU law practice, Rhodri has appeared in a series of important EU-related public law cases both for and against the Government, including several of the leading cases relating to State liability for breaches of EU law, including Factortame, Dillenkofer and Three Rivers District Council v. Bank of England.

He recently acted in an appeal concerning the application of the EU public procurement rules to the Government’s Academies schools programme and a judicial review in respect of the powers of the BAA and CAA to confiscate aeroplanes from lessors to enforce the airport charges of their insolvent lessees.
